For suffered physical pain, for suffered mental pain due to reduced life activity, humiliation, injury to reputation, honor, freedom or personal rights, death of a close person, as well as for fear, the court will, if it finds that the circumstances of the case, especially the intensity of pain and fear and their duration justifies it, to award a fair monetary compensation, independent of compensation for material damage as well as in its absence.
In the event of a violation of personal rights, the court can order, at the expense of the injured party, the publication of the judgment, i.e. corrections, or order the injured party to retract the statement by which the injury was committed, or anything else that can achieve the purpose achieved by compensation.
When deciding on a request for compensation for non-material damage, as well as the amount of compensation, the court will take into account the importance of the damaged property and the purpose of that compensation, but also that it does not favor aspirations that are not compatible with its nature and social purpose .
In the case of the death of a person, the court can award the members of his immediate family (spouse, children and parents) fair monetary compensation for their mental pain. Such compensation can also be awarded to brothers and sisters if there was a more permanent community of life between them and the deceased.
In the case of a particularly severe disability of a person, the court can award his spouse, children and parents fair financial compensation for their mental pain.
In case of death, bodily injury or damage to health, compensation is determined as a rule, in the form of a cash annuity, for life or for a certain period of time.
The monetary annuity awarded in the name of damages is paid monthly in advance, unless the court orders otherwise.
The creditor has the right to demand the necessary security for the payment of rent, unless this would be justified according to the circumstances of the case.
If the debtor does not provide the security determined by the court, the creditor has the right to demand that instead of an annuity, a total amount is paid to him, the amount of which is determined according to the amount of the annuity and the probable duration of the creditor’s life, with the deduction of appropriate interest.
For serious reasons, the creditor can also in other cases demand, immediately or later, that the total amount be paid to him instead of the rent.
Whoever inflicts physical injury or harms another person’s health, is obliged to compensate him for the costs of treatment and other necessary expenses in this connection, as well as the earnings lost due to the inability to work during the treatment.
If the injured person loses his earnings due to complete or partial incapacity for work, or his needs are permanently increased, or the possibilities of his further development and advancement are destroyed or reduced, the responsible person is obliged to pay the injured person a certain monetary annuity, as compensation for that damage.
The right to compensation in the form of an annuity due to the death of a close person or due to bodily injury or damage to health cannot be transferred to another person.
Due amounts of compensation can be transferred to another, if the amount of compensation is determined by a written agreement of the parties or a final court decision.
Whoever injures another person’s honor, as well as who makes or transmits untrue statements about the past, about knowledge, about the ability of another person, or about anything else, and knows or should have known that they are untrue, and thereby causes him material damage, is obliged to compensate him. There will be no liability for damages if the person who makes an untrue statement about another does not know that it is untrue, if he or the person to whom he made the statement had a serious interest in it.
